This Legal Notice is correct as at 29 April 2022 and may be updated from time to time.  This Legal Notice supersedes previous legal notices issued by Tierra.

Our scope of service

Tierra Underwriting Limited is an insurance intermediary, Managing General Agent and approved Lloyd’s Coverholder, acting on behalf of one or more insurance undertakings, mandated to accept coverage of non-EEA risks and to write and manage insurance contracts in the name and on behalf of certain insurance undertakings including Lloyd’s syndicates Westfield Specialty Syndicate 1200 and Ascot  Syndicate 1414.

Your duty of fair representation

Your insurance is based upon the information provided to Tierra (and, in turn, the insurance undertakings in which Tierra writes on behalf of).  You have a duty to make a fair presentation of the risk before your insurance is placed, at renewal and when varying or extending your policy in accordance with the terms of your insurance contract.  This means all material representations must be true and you must disclose all material information or circumstances known, or ought to be known, to you to insurers in a clear and accessible manner.  Material information is information that may influence the acceptance or assessment of your insurance by Tierra (and insurance undertakings). 

Tierra does not act on behalf of the client. 

 

Failure to make fair presentation may adversely affect your ability to recover a claim or the validity of your insurance and could mean that part, or all, of a claim may not be paid.

Protecting your information

It is acknowledged by your company that, for the proper purposes of underwriting any insurances or making any claims, Tierra will be required pursuant to the general law to provide material information provided to Tierra by its clients, brokers, insurance undertaking, loss adjusters and others involved in the placement of such insurances, premium collections or handling of claims arising thereunder.

How to claim

Please refer to your insurance policy if you need to notify a claim. You should contact your broker or your insurer as soon as possible using the contact details detailed within your insurance policy.

Fees and charges

The insurance services purchased by clients of Tierra are subject to the following remuneration arrangements.  Tierra receives usual and customary commissions or fees (and may occasionally receive fees in addition to commissions) for its services at inception and at renewal and on amendment if applicable, which are calculated as a percentage of the total premium and payable by insurers.  In addition to such commissions and fees, Tierra may also receive investment income on fiduciary funds (generally insurance premiums or return premiums) temporarily held by it.  

 

Clients with more specific questions about the remuneration received by Tierra in relation to their insurance should contact the Managing Director at the address hereunder, for any further information.

Complaints

We are committed to providing a high level of service at all times.  However if you have reason to make a complaint about our service you should contact the Managing Director at the contact details hereunder.  We will acknowledge your complaint within three working days of receipt and explain to you how we intend handling it.  Whilst we will endeavour to investigate all complaints immediately, we undertake to give you a written response to your complaint within twenty working days or, if further time to investigate the complaint is required, to update you with the progress and to agree with you timescales for resolution.  If our response and/or resolution would not satisfy you, you may, under certain conditions, also file a complaint with:

 

  1. The Financial Ombudsman Service in the UK

  2. The Ombudsman van de Verzekeringen/Ombudsman des Assurances in Belgium

Conflicts of Interest

It is our aim to avoid any potential or actual conflicts of interest in our dealings with you.  If a conflict does arise, we will advise you of this in writing and obtain your permission before proceeding.  This agreement will not prevent us from agreeing to underwrite insurance for other clients who may be competitors of yours.  In the event that we identify such a conflict of interest in our providing any services to you we will notify you as soon as reasonably practicable and where we are able to do so, agree how to continue to provide the services.

 

It should be noted that Tierra is a subsidiary within the Texel Group, which predominately constitutes other subsidiaries acting as an insurance broker in the UK, Europe, Singapore, and the US.  Appropriate Chinese walls have been put in place to mitigate the risk of a conflict of interest, and to ensure that respective duties owed to clients and insurers by the relevant broking arms and Tierra do not conflict.  Please contact the Managing Director using the contact details herein should you require further information.

 

Nothing in this agreement overrides or discharges our duty to act honestly, fairly and professionally, and in the client’s best interest, at all times.  This agreement shall not override any legal or regulatory requirements which may apply to us prevailing from time to time regarding your insurance policy or the handling of claims.
